NO on Prop 98
and YES on Prop 99!

The Committee for Green Foothills joins a long list of environmental and community groups urging you to vote NO on Proposition 98 and YES on Proposition 99.

What’s happening
Proposition 98 is the “Hidden Agenda” land developer initiative that could restrict environmental land use protections while Proposition 99 could supercede Prop. 98 and provide straightforward protection against abuse of eminent domain powers.

Why this is important
Proposition 98 is a rehashed version of the defeated initiative by land developers in 2006, then called Proposition 90. While developers want voters to believe it is only about “eminent domain,” the vaguely-written provisions are designed to open courthouse doors to developers who will label any environmental restriction as a prohibited “transfer of economic benefit.” In many ways it is even worse than Proposition 90, with no exceptions for regulations that protect health and safety. The proposition could even be used to overturn recent California laws that fight global warming on the grounds that they are a prohibited “transfer of economic benefit” to renewable energy producers.

Proposition 99 accomplishes the goal that many voters might have expected from Proposition 98. It stops government from taking owner-occupied homes to transfer them to private developers, a potential abuse of eminent domain power. Passing Proposition 99 with more votes than Prop. 98 means Prop. 99 will take precedence, and it will reduce support for more “Hidden Agenda” land developer propositions in the future.
